PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE APP.
In these Terms:
Business means the business which has elected to utilise the SwipedOn app as part of its employee and visitor management system;
Content means any and all data, text, software, images, audio or video material and other content, in any medium, provided by SwipedOnto you;
Employee means an employee of the Business;
Intellectual Property means all intellectual property rights, including all copyright, patents, trade marks, design rights, trade secrets, domain names, know-how and other rights of a similar nature, whether registrable or not and whether registered or not, and any applications for registration or rights to make such an application;
SwipedOn App means the online employee and visitor management cloud service platform provided by SwipedOn to provide a management interface for Businesses to organise their Employees and Visitors;
Us, We, Our meansSwiped On Limited, NZ Company No. 655878;
User means a person who gains access to the SwipedOn App, whether as a registered User in the capacity of the Business, Employees, or Visitors;
User’s Content means the User’s Intellectual Property to be incorporated the SwipedOn App including but not limited to personal information, comments, times, photographs, or signatures;
Visitor means a visitor or contractor of the Business; and
You means you, the person using the SwipedOn App in your capacity as a User.
This indemnification section survives the expiration of your registration, and applies to claims arising both before and after the registration ends.
We shall be under no liability to you in respect of anything that, if not for this provision, would or might constitute a breach of these Terms, where this arises out of circumstances beyond our control, including but not limited to:
If any court decides that any of the provisions of these Terms are invalid, unlawful or unenforceable to any extent, that term will, to that extent only, be severed from the remaining terms. The rest of these Terms will continue to be valid.
These Terms is governed by the laws of New Zealand and each party submits to the jurisdiction of the courts of the New Zealand.
